Shilpa Patel, Director, Intellectual Property

Shilpa Patel Dr. Shilpa Patel directs the procurement and development of intellectual property at NYU. 

Dr. Patel earned her PhD in Pharmacology from Yale University.  Her thesis explored administering less toxic chemotherapy doses to kill ovarian cancer cells undergoing a stress response, which was elicited by targeted delivery of a misfolded protein, compared to non-stressed ovarian cancer cells.  During the completion of her doctorate, Dr. Patel pursued her interest in the interaction between patent law and biotechnology and pharmaceutical sciences as an Editor for Yale Law School’s Journal of Law & Technology (YJoLT) and designed, managed, and conducted patent-focused projects for Yale start-up biotechnology companies. Following completion of her doctorate, Dr. Patel earned her JD from Fordham Law School. 

 Dr. Patel has extensive experience with the protection of intellectual property; for example, from patent procurement through litigation.  While working in a law firm setting, she has served as outside counsel for a variety of clients in a myriad of technologies in the biotechnology and pharmaceutical sciences.  Specifically, she has drafted and prosecuted United States and foreign (in over 70 countries) patent applications, conducted freedom-to-operate, patent due diligence, patentability assessments, and inventorship analyses, and client portfolio counseling.  She also has handled in the law firm setting, as well as in-house counsel for a pharmaceutical company, complex intellectual property litigation, counseled on Hatch Waxman issues, and handled all stages of securing U.S. trademark protection including advising clients on selection and adoption of new trademarks, rendering opinions on the availability and proper use of trademarks, and advising on protection and enforcement strategies for trademarks.  Additional responsibilities as in-house counsel included assisting Research & Development with formulation and technical development strategies; conducting freedom-to-operate analyses, API/process clearances and patent opinion analyses; developing pre-litigation and litigation strategies and supporting preparation pertaining to generic targets, generic pipeline products, and specialty branded products; assisting in the preparation, negotiation, review and revision of contracts, internal policies and protocols, assignments, development/collaboration agreements and licenses. 

Dr. Patel is a licensed attorney in the States of New York and Jersey, and is registered to practice before the United States Patent and Trademark Office.
